There are essentially two legal proceedings for every driving under the influence arrest: one in the court system and one with the Department of Motor Vehicles.
The Department of Motor Vehicles will handle the suspension or revocation of a person's license, as well as the reinstatement of the license.
The only two issues discussed in DMV hearings are whether the accused took a blood or urine test and what the result of the test was.
The DMV hearing does not substitute for a court hearing and a person is not required to request a DMV hearing.
If a person is found innocent in court but their license was suspended or revoked, the DMV will reinstate the license.
