Proposition 36, also known as the Substance Abuse and Crime Prevention Act, was passed in November 2000 by 61 percent of voters. The proposition allowed treatment of first-time and second-time nonviolent simple drug possession offenders a chance to receive drug abuse treatment in lieu of prison time.
The treatment may be community-based drug programs, which may include outpatient treatment, halfway house treatment, narcotic replacement therapy, drug education or prevention courses, or limited inpatient or residential treatment. Deferred Entry of Judgment (Penal Code Section 1000)
Penal Code Section 1000 allows a person to get relief from certain limited drug and alcohol offenses.
The policy in California is that certain drug and alcohol offenders should not serve jail time.
A person charged with one of these offenses must enter a guilty plea that the court does not enter as a judgment of conviction.
After the completion of a designated drug program and drug-free behavior, and a payment of a small fee for court costs, the court enters a judgment of dismissal.
In our experience, many defendants don't take proper advantage of PC 1000. But it does require that a person be completely drug free until the court dismisses the case.
